The Brazilian Federal Government, through the Ministry of Labor and Employment and with participation from business and labor representatives via the Permanent Tripartite Commission (CTPP)—a regulatory body composed of representatives from the government, employers, and employees—has included mental health as a criterion in the prevention of workplace harassment. This update is part of the Risk Management Program (PGR) under Regulatory Standard No. 1 (NR-01) and is intended to promote psychosocial protection in the workplace.
Effective May 2026, companies must assess and manage psychosocial risks under the PGR. They must identify any such risks in the workplace, revise their occupational health and safety documentation, and evaluate their work environment. Qualified professionals—such as occupational physicians and safety technicians—must carry out this assessment, with legal oversight to avoid judicial exposure. The Ministry of Labor and Employment is preparing a guidance manual, which is expected to be issued before the rule takes effect.
