LAW 14.611/2023: EQUAL PAY BETWEEN MEN AND WOMEN

In effect in Brazil since July 4, 2023, Law 14.611/2023 ensures salary parity and equal remuneration criteria between female and male workers. The law reaffirms the equality of rights between men and women, reinforcing measures to guarantee equal pay and including penalties for non-compliance with legal obligations.

All businesses in Brazil with more than 100 employees must publish the Salary Transparency and Remuneration Criteria Report and the Action Plan for Mitigating Salary and Remuneration Criteria Inequality between Men and Women twice a year, in March and September. The document will be disclosed by the Ministry of Labor and Employment through collected data and will serve to compare salaries, remunerations, the proportion of job positions held, and must comply with the General Data Protection Law (LGPD).

In the event of non-compliance with the new legislation, companies will be subject to an administrative fine of up to 3% of the payroll, limited to 100 minimum wages, in addition to the sanctions applicable in cases of salary discrimination.
