NR-01: Mental Health and Psychosocial Risk Enforcement to Begin on 26 May 2026

Work place mental health has moved to the forefront of Brazil’s regulatory agenda. Effective 26 May 2026, the amended Regulatory Standard No. 1 (NR-01) – as established by MTE Ordinance No. 765/2025 – will require companies to integrate psychosocial risk management, including mental health as part of harassment-prevention measures, into their mandatory Risk Management Programs (PGR). 

Key Compliance Requirements 

The new framework demands a proactive shift in how organizations handle occupational health and safety (OHS): 

  • Psychosocial Risk Assessment:Companies must identify, assess, and manage psychosocial risks within their PGR. This includes a comprehensive review of all current OHS documentation to ensure alignment with the new psychosocial protection requirements. 
  • Customized Evaluation:Given that psychosocial risks are inherently company-specific, organizations must evaluate their unique workplace environments rather than adopting generic templates. 
  • Technical and Legal Synergy:Monitoring should be conducted by qualified professionals – such as occupational physicians and safety technicians – and must be supported by legal oversight to mitigate potential litigation and judicial impacts. 

 

Practical Impact 

The enforcement of psychosocial protection measures marks a significant evolution in labor compliance. Organizations must act now to align their OHS protocols with these new requirements. An integrated approach combining technical expertise with legal oversight is essential to ensuring regulatory compliancereducing vulnerabilities, and preventing long-term labor liabilities.
