With seven months remaining before Brazil’s existing federal consumption taxes are replaced by a new value-added tax system, at least 22 issues still require joint regulation by the federal tax authority and the governing committee responsible for the new state-and-municipal VAT, according to a survey by law firm Martinelli Advogados. Among the most important unresolved topics, tax specialists say, are invoicing procedures, the implementation of split payment. and the definition of market value for tax purposes.

Two supplementary laws and the main regulations governing the new taxes have already been published, but specialists argue that significant gaps remain. “The regulations are largely a copy-and-paste exercise. We expected more detail,” said Eduardo Lucas, a partner at Martinelli Advogados.
In his view, the fact that additional rules are still required after the publication of two supplementary laws and the main regulatory framework suggests that authorities have not yet reached sufficient operational clarity.
